Order on Board 04/04/2025
1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No. 07/2025 registered at Police Station Pithora, District Mahasamund, Chhattisgarh for the offence punishable under Sections 318(4) and GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.04.05 18:49:39 +0530
2 319(2) of Bharatiya Nyaya Sanhita, 2023.
2. The prosecution story in brief is that on 15.01.2025, the complainant Aditya Kumar Dubey made a written complaint to the Police of Police Officer Pithora, District Mahasamund (C.G.) stating that on 25.12.2024, he received a phone call from one person, who address herself as Geetanjali and claims to be the friend of his Niece i.e. Lakshmila Sen. It has been informed to the complainant that her father had met with an accident and required money for medical treatment. Based on this false information, they received a total of ₹7,27,000/- from the complainant between 25.12.2024 to 12.01.2025 through PhonePe on different bank accounts using the mobile numbers 9174757898 and
7224062230. Thereafter, the First Information Report (F.I.R.) was registered for the commission of offence punishable under section 318(4) and 319(2) of the Bharatiya Nyaya Sanhita, 2023 and the present applicant was arrested on 15.01.2025.
3.
Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. He would submit that on several occasions, the alleged amount was transferred by the complainant and no complaint was lodged by that relevant point of time i.e. 25.12.2024 to 12.01.2025. Hence, there is a delay in lodging the FIR. He would further submit that the alleged amount has been transferred in the Bank Account of Kamta Prasad Sahu, Khem Ram, Dhani Sahu, Dhanai Bai. No amount has been transferred in the bank account of the present applicant. He would submit that applicant is in jail since 15.01.2025, charge sheet has been filed and conclusion of trial is likely to take some time, therefore, he prays for grant of bail to the applicant.

4. On the other hand, learned counsel for the State opposes the bail application and he would submit that the charge sheet has been filed in this case.
5. I have heard learned counsel for the parties and perused the case diary.
6. Considering the facts & circumstances of the case, nature & gravity of the offence and also considering the fact that online fraud has been committed and amount of Rs.7,27,000/- has been received from the complainant between 25.12.2024 to 12.01.2025 through PhonePe on different bank accounts using the mobile numbers 9174757898 and 7224062230 on the ground that complainant’s father met with an accident and required money for medical treatment, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of applicant-Shadanand (Sadanand) @ Ganesh Sahu involved in Crime No. 07/2025 registered at Police Station Pithora, District Mahasamund, Chhattisgarh for the offence punishable under Sections 318(4) and 319(2) of Bharatiya Nyaya Sanhita, 2023, is rejected.
7. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information. Sd/-
