HON'BLE BRIJ RAJ SINGH, J. This petition has been filed with the following prayers :-
“To issue a writ, order or direction in the nature of mandamus commanding the opposite parties namely opposite party no.3 not to interfere in peaceful possession over petitioner’s share of gata no.326, situated at village Mansoor Nagar Sain Gaon, Pargana Chadra, Tehsil Nanpara, District Bahraich.” We have heard learned counsel for the petitioner, learned Standing Counsel and Shri Dhananjay Kumar Tripathi who has filed power on behalf of opposite party no.2. We have gone through the representation made by the petitioner to the Supdt of Police, Bahraich from which it is evident that petitioner has bought part of Gata no.326 M in village Mansoornagar Sia Gaon, Pargana Charda in Tehsil Nanpara, District - Bahraich in year 2008 and constructed house and shop over it but the private respondent no.4 is interfering in her peaceful possession. Dispute is purely private in nature. Writ petition cannot be entertained in such cases. It is accordingly dismissed leaving it open to the petitioner to approach appropriate civil court.
