Heard learned counsel for the applicant, learned AGA for the State and perused the record. The instant application under section 483 Cr.P.C. has been filed with the prayer to direct the Additional Chief Judicial Magistrate/Civil Judge (SD), Balrampur to conclude the trial of Criminal Case No. 1402 of 2024; State Vs. Rajdei and others, arising out of Case Crime No. 22 of 2024, under Sections 352, 406, 504, 506, 120-B, 420, 467, 468, 471 IPC, Police Station Gaura Chauraha, District Balrampur, expeditiously. Learned counsel appearing for the applicant submits that the matter pertains to the year 2024, but even after passing of one year, the proceeding of the case has not been concluded as yet. After arguing at length, learned counsel appearing for the applicant submits that interest of justice would be sub-surved if this Hon'ble Court may be pleased to direct the trial court to decide the matter within the stipulated period of time as may be fixed by this court. Considering aforesaid innocuous prayer, the learned Additional Chief Judicial Magistrate/Civil Judge (SD), Balrampur is directed to conclude the trial of Criminal Case No. 1402 of 2024; State Vs. Rajdei and others, arising out of Case Crime No. 22 of 2024, under Sections 352, 406, 504, 506, 120-B, 420, 467, 468, 471 IPC, Police Versus Counsel for Applicant(s) : Piyush Kumar Singh, Shivam Tiwari Counsel for Opposite Party(s) : G.A. Ram Tirth Nishad .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. And 3 Others .....Opposite Party(s) Station Gaura Chauraha, District Balrampur, with expedition, in accordance with law considering the instructions and guidelines issued by this court; time to time.
