By the present petition, the petitioner is questioning the order dated 10-9-2022 (Annexure – P/1) passed by the respondent No.2 (for brevity ‘the Board’) by which the application for correction of date of birth of the petitioner has been rejected on the ground that there is some overwriting in the Primary School Marksheet and the copy of birth certificate which has been produced by the petitioner is of the year 2021, which is subsequent to passing date of high school examination. 2. From the pleadings of the petition, it is apparent that the actual date of birth of the petitioner is 11-2-2003, but in the marksheet dated 23-11- 2019 it has been recorded as 10-2-2000 for which the petitioner submitted an application before the Board for necessary correction on 22-2-2022, which is within the stipulated time period i.e. 3 years, as enumerated in the guidelines of the Board, but the said application has been rejected by assigning the reason, which cannot be a ground for rejection of the application of the petitioner. 3. Learned counsel appearing for the State and the Board would submit that the application of the petitioner has been rejected on the ground that there is some overwriting in the primary school document of the petitioner and the date of birth certificate produced by the petitioner was of the year 2021, which is subsequent to the date of passing of examination. 3 WPC No.1963 of 2023 4. I have heard learned counsel appearing for the respondents and perused the documents as also the guidelines prescribed by the Board. 5. The guidelines prescribed that the application for correction of date of birth should be made within a period of three years from the date of passing of examination of class 10th and admittedly the petitioner has submitted his application within the stipulated period of three years from the date of passing the examination, however, the application for correction of date of birth has been rejected on the ground, which was not part of the guidelines of the Board. 6. In view of foregoing, the order impugned dated 10-9-2022 passed by the Board is quashed and it is directed to reconsider the application submitted by the petitioner for correction of date of birth in the 10th class marksheet taking into consideration of actual date of birth of the petitioner, which was produced by him before the Board. The entire shall be carried out at the earliest preferably within a period of 30 days from the date of receipt of copy of this order. 7. With the aforesaid observations and directions, the writ petition stands disposed of.
