Mr. Ravi Bisht, learned counsel for the applicant. 2. Mr. Tumul K. Nainwal, learned A.G.A. for the State. 3. The applicant – Monu Yadav, who is in judicial custody in connection with FIR/ Case Crime No. 0261 of 2025, under Section 80(2) of BNS, 2023, registered at P.S.- Rishikesh, District Dehradun, has sought his release on bail. 4. In this case, an FIR was lodged by the brother of the deceased, wherein, it was alleged that deceased and accused got married on 29.11.2019 and the accused used to continuously harass and physically abuse the deceased, who was his wife and ultimately, she committed the suicide by hanging on 30.05.2025. Charges under Section 80(2) of the BNS were framed. 5. Heard learned counsel for the parties and perused the records. 6. Learned counsel for the applicant would submit that the ingredients of Section 80(2) of the BNS are not made out against the applicant as there is no evidence on record to show that the accused used to harass the deceased for or in connection with demand of dowry. Learned counsel for the applicant would further submit that chargesheet has been filed and there is no chance of tampering with the evidence. 7. Per contra, learned State Counsel vehemently opposed the bail application and would submit that the offence alleged is of a grave and heinous nature. 8. Having considered the submissions, under the facts and circumstances of the case, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 9. Accordingly, the present bail application is allowed. 10. Let the applicant be released on bail on his executing a personal bond and furnishing two reliable sureties each of the like amount, to the satisfaction of the court concerned.
