Respondents PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the respondents 1 to 3 to conduct the survey and fix the four boundaries and install the survey stones in SF No. 39/1A1 situate at Mannakudi Village, Aranthangi Taluk, Pudukkottai District with help of the police aid and subdivided the property in SF No. 39/1A1 with an extent of 1 Acre 12 Cents in the light of petitioners sale deed dated 12.08.1996 with in a time stipulated by this Honble court For Petitioner :M/s.R.Paranjothi for M/s. 3. Mr.B.Saravanan, learned Additional Government Pleader, accepts notice for respondents 1 to 3. Mr.S.Prakash, learned Government Advocate, accepts notice for the fourth respondent. Since the petitioner is one of the joint pattadhars, learned Additional Government Pleader submits that the survey would be conducted after putting the other joint pattadhars and owners of neighbouring lands on notice. 4. Joint Patta No.298 has been issued in the names of Chellaiah, Natrajan and the petitioner. From the cause-title, it appears that Raja and Arumugam, sons of Chellaiah have been joined as respondents. Natrajan has not been joined as respondent. Learned counsel for the petitioner submits that the joint pattadhars have no objection to the survey and that the objection is by Chidambaram and Sivakumar, who are owners of neighbouring lands.
In these circumstances, it is just and necessary to put Chidambaram, Sivakumar and Chellaiah or his legal heirs on notice before acting on the petitioner's request for a survey. 5.
