Mr. Pankaj Kumar, Advocate, holding brief of Mr. Neeraj Garg, Advocate for respondent no. 5. 4. Petitioners were engaged on contract as Bandi Rakshak in Sub-Jail Roorkee, District Haridwar. Their engagement was discontinued w.e.f. 24.2.2024. Petitioners filed WPSS No. 405 of 2024, which was disposed of with a direction to the Superintendent, Sub- Jail, Roorkee to take decision on the representation submitted by the petitioners. The representation made by the petitioner, however, has been rejected by the Superintendent, Sub-Jail Roorkee, vide order dated 20.03.2024 on the ground that there is now no vacancy on the post of Bandi Rakshak left in Sub- Jail, Roorkee, as regular appointees have joined duties as Bandi Rakshak. 5. Learned counsel for the petitioner, however, submits that there are as many as seven vacancies still available on the post of Bandi Rakshak in Sub-Jail, Roorkee, therefore, the reason assigned for not considering the claim of the petitioners for re-engagement is 2025:UHC:10226 incorrect. It is further contended that petitioners have served for long period as Bandi Rakshak, thereby earned valuable experience; therefore, engaging fresh hands by replaying petitioners would be neither in public interest nor in the interest of administration. 6. Having regard to the statement made by learned counsel for the petitioners that seven vacancies are still available on the post of Bandi Rakshak, the writ petition is disposed of with liberty to petitioners to make representation(s) to the Superintendent, Sub-Jail, Roorkee. In the representation(s), they will give the details of the vacancies available on the post of Bandi Rakshak. If petitioners make representation(s) within two weeks from today, decision thereupon shall be taken, within six weeks thereafter.
