Hemchandra, learned senior counsel assisted by Ms. Rinika Maibam, learned counsel appearing for the petitioner and Mr. Shyam Sharma, learned GA appearing for the respondents. In view of the limited prayer made on behalf of the petitioner and as agreed to by both the counsel appearing for the parties, the present writ petition is being disposed of at the Motion stage itself. It has been submitted by Mr. M. Hemchandra, learned senior appearing for the petitioner that the Deputy Inspector General of Police (AP-I), Manipur issued an order dated 11-11-2024 thereby revoking the order issued by the Commandant, 2nd Indian Reserve Battalion by which the service of the son of the present petitioner was terminated and subsequent to the order dated 25-11-2024 issued by the Commandant 2nd, Indian Reserve Battalion, Naranseina, Bishnupur, thereby revoking the earlier order terminating the service of the son of the petitioner and dropping the departmental enquiry initiated against him, the petitioner submitted a representation to the concerned authorities of the State Government praying for releasing the pensionary and other retiral benefits due payable to the deceased Government employee, who is the son of the petitioner. The learned senior counsel submitted that the petitioner will be satisfied for the time being if the present writ petition is disposed of by directing the Commandant, 2nd Indian Reserve Battalion (IRB), Naranseina, Bishnupur to consider the said representation on its own merit and in terms of the applicable rules and to dispose of the same by issuing appropriate orders within a stipulated period. Mr. Shyam Sharma, learned GA appearing for the respondents fairly submitted that as the prayer made on behalf of the petitioner is confined to the consideration and disposal of the representation submitted by her, he has no objection in disposing of the present writ petition as prayed for by the learned senior counsel appearing for the petitioner. Taking into consideration the submission advanced by the learned counsel appearing for the parties, this court is of the considered view that it will be in the interest of justice to issue the following directions:- (i) The Commandant, 2nd Indian Reserve Battalion, Naranseina, Bishnupur is hereby directed to consider the said representation dated 18-07-2024 submitted by the petitioner on its own merit and in terms of the applicable rules and to dispose of the same by issuing appropriate orders; and (ii) It is made clear that the whole exercise should be completed within a period of three months from the date of receipt of a certified copy of this order. With the aforesaid directions, the present writ petition is disposed of. JUDGE Devananda -2-
