Heard learned counsel for the petitioner and learned Standing Counsel for the State. 2. This writ petition has been filed with the following main prayer :- "(i) issue a writ, order or direction in the nature of mandamus thereby commanding and directing the opposite parties no. 2 to 5 to conduct the appropriate enquiry in the matter and till then the construction of Nali being made by the opposite party nos. 6 to 12 may be stopped forthwith, in the interest of justice " 3. We have gone through the representation made by the petitioner on Sampurna Samadhan Diwas, at Tehsil Jaisinghpur, District Sultanpur, a copy of which has been filed at page 22 of the paper book from which it is evident that the petitioner has a dispute with Sanjay, Son of Sabodh, Rajatram, Son of Rammilan, Lalbahadur, son of Ramsubhas, Dilip- Son of Ramajore, Sanjay- Son of Siyaram, Deepak-Son of Tej Bahadur were constructing Nali on the Sahan of the petitioner. 4. Learned Standing Counsel has produced before this Court instructions sent by Tehsildar, Jaisinghpur, Sultanpur wherein it has been stated that the land in question is recorded as in Category 6 (2) as village Abadi Gata No.919/2.1930 hectare was inspected by the Revenue team. The house of the petitioner is ancestral land and has been built on such village abadi since long. The petitioner has bought certain land from erstwhile tenure holder adjacent to her house from Smt. Kalawati, Wife of Parasnath. Such land also has one Nala built by the Gram Sabha. Petitioner has filed a suit for permanent injunction No.3291 of 2025 in the court of Civil Judge, (Junior Division), Sultanpur, which is pending.
