SRINIVASU L counsel for the Respondent/COmPlainant: 1.PUBLIC PROSECUTOR The Court made the following Order: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the Petitioners herein/Al and A2, seeking regular bail, in crime No.15 of 2025 of RSASTF Police Stat'lon, Tirupathi, registered for the OffenCeS Punishable under Sections 303(2) read With 3(5), 49, 61(2) of the BNS and Section 20(1)(d)(i)(a) read With 20(1)(c) ii, iii, iV, X, 36(a) read With 32A, 29(4)(i)(a) of the A.P. Forest (Amendment) Act, 2016. 2. 2. Br'lef facts Of the Case are that this iS a Case Of Criminal conspiracy, abetment to commit the offence, criminally trespassed into reserve forest without permission, cut the live red sander trees and committed theft and trying to shift by loading for the Purpose Of smuggling red sander logs that occurred on 13.03.2025 at 05.00 --- I 2 I/ AM, on Vepakunta cross-Tirumala Kuppam, Main road, near Ramasamudram village, Narayanavanam Forest Beat, Puttur Mandal, wherein Al and A2 were arrested and 112 red sander logs, weighl'ng 920'Kgs, Mahindra XYLO Car bearI-ng No. AP27 AK 2115, 2 number plates and o2 cell phones were seized from their possession. 3. Heard. Perused the record. 4. Learned counsel for the petitioners submits that the PetitI-OnerS have been in J-udiCial Custody from 13.03.2025 and most of the investigation in the present crime is completed and hence, he prays this Court to grant bail to the petitioners herein. 5. On the other hand, learned Assistant Public Prosecutor opposed tO grant bail to the petitioners on the ground that investigation in the present crime is not completed. According to hl's instructions, no antecedents have been reported against the petitioners. 6. As seen from the record, the petjtI-OnerS herein Were ?rrested on 13.03.2025 and since then they have been languishI-ng in jail. In the said facts of the case, this court views that most of the investigation might have been completed by this time and any further detention of the petitioners is no longer required to conduct further l'nvestigation. lt I'S Submitted by the learned counsel for the petitioners that the petitioners have permanent abode and there is r55Z-. to -r+A,irTh-JL-t'`-ulRE 3 Jr/ no possib"ty of their fleeing away from the JurisdlCtiOn Of the Court. 7. ln View Of the facts and Circumstances Of the Case and considering the remand period of the petitioners, th-ls court is inclined to grant ba" to the petitioners herein, on the following conditions. i. The petitioners herein Shall be released On executing a personal bond for Rs.25,000/- (Rupees twenty five thousand OnM each with two sureties for a like sum each to the satlsfaction of the learned Judicial Magistrate Of First Class for Trial of Cases relating to Red Sander Smuggling, Tirupati. I,i. on release, the petitioners shall appear before the station House Officer COnCerned, On every Sunday, between 10.00 AM and o1.00 PM., for a Period Of three (3) months. iii. The Pet'lt-lOnerS Shall make themselves available for investigat-Ion as and when required and that they she" not cause any threat, inducement or promlse to the prosecution witnesses. 8.
