Neutral Citation No. - 2025:AHC:19180-DB Court No. - 29 Case :- WRIT - C No. - 3697 of 2025 Petitioner :- Manoj Kumar Agarwal Respondent :- Union Of India And 2 Others Counsel for Petitioner :- Salman Ahmad Counsel for Respondent :- A.S.G.I.,Anoop Tiwari Hon'ble Ashwani Kumar Mishra,J. Hon'ble Arun Kumar Singh Deshwal,J. Petitioner's application for renewal of his passport apparently has been kept pending on account of his conviction in a case under the Gambling Act.
Learned counsel for the petitioner submits that the provisions of the Passport Act clearly indicate issuance of passport in a case where conviction involving moral turpitude is for a period of two years. Reliance is placed upon Section 6(2)(e) of the Passport Act, 1967. It is submitted that since the petitioner has only been imposed fine for the offence, as such, merely for such reasons denial of renewal of passport would be arbitrary. Sri Anoop Tiwari, learned counsel appearing for the respondents states that this aspect of the matter would be examined by the competent authority and appropriate decision would be taken in the matter. In that view of the matter, this writ petition stands disposed of with a direction upon the second respondent to accord
consideration to petitioner's application for renewal of passport, in accordance with the provisions of the Passport Act, 1967 and keeping in view the observation made above, within a period of six weeks, from the date of presentation of a certified copy of this order.
