Order 13/05/2025
1. The present civil writ petition under Article 227 of the Constitution of India has been filed by the petitioner against the
order dated 28.03.2025 passed by the Court of learned Additional District & Sessions Judge No.2, Jaipur District, Jaipur, in Civil Suit No.331/2018 (577/2015), whereby the application filed under Section 151 C.P.C. for opening the opportunity of evidence has been dismissed.

Learned counsel for the petitioner submits that the present petitioner is an old lady aged about 73 years and due to her ill health, she could not be appeared before the learned Trial Court
[2025:RJ-JP:19989] (2 of 3) [CW-6806/2025] for her evidence and ultimately, her evidence was closed on
18.01.2025. Learned counsel further submits that the learned Trial Court, without considering the facts & circumstances, dismissed the aforesaid application filed under Section 151 C.P.C. Therefore, in view of the submissions made herein-above, the present writ petition may be allowed and the impugned order dated 28.03.2025 be quashed & set aside.
3. Heard learned counsel for the petitioner & gone through the impugned order dated 28.03.2025 and the other material available on record.
4. Perusal of the impugned order dated 28.03.2025 reveals that the evidence of the plaintiff was closed on 08.03.2019 and the evidences of defendants was closed on 23.09.2019. Thereafter, on 03.03.2021, the learned Trial Court re-opened the evidence of the defendants while disposing off their application.
