This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 praying for grant of pre-arrest bail to the accused/petitioner, who is apprehending arrest in connection with Moirabari P. S. Case No. 113/2024, under Sections 329(4)/64/351(2) of BNS. Ms. Sultana, learned counsel for the petitioner, submits that the case has already been charge-sheeted, vide Charge-Sheet No. 145/2024, dated 31.10.2024, and thereafter, the present petitioner had already appeared before the learned Trial Court. Hence, the present anticipatory bail application has become infructuous. Considering the submissions of learned counsel for the petitioner that the case has already been charge-sheeted, vide Charge-Sheet No. 145/2024, dated 31.10.2024, and that the petitioner has already appeared before the Trial Court, the present anticipatory bail application has become infructuous, as the apprehension of arrest during the investigation does not arise at this stage.
