State of U.P. and Others'. The application is supported with an affidavit. There is no objection on behalf of opposite parties. The ground taken in the affidavit is sufficient. Accordingly, the application is allowed. The delay in filing the review petition is condoned. Order on Review Petition:- Heard Sri Sudeep Seth, learned Senior Advocate for the review applicant and learned Standing Counsel for State. Present review petition is filed for review of judgment and order dated 3.01.2022 passed by Co-ordinate Bench of this Court in Special Appeal No.9 of 2022; 'Sushil Kumar Pandey Vs. State of U.P. and Others'. The sole submission of Sri Sudeep Seth, learned Senior Advocate for review applicant is that there is misconception of facts and law by the Division Bench while deciding the Special Appeal. In the garb of the said submission he tries to raise all the facts of question and law available to the appellant. We do not find ourselves to apply our minds on the questions of fact and law on the judgment of a Co-ordinate Bench. We can only look into the apparent errors, if any made on record. In the given facts and circumstances of the case, present review petition is not maintainable and the same is dismissed.
