NHAI Vs. Gandhi Ram and Ors.
Arb. Appeal No.187 of 2024
19.09.2025 Present: Ms. Shreya Chauhan, Advocate, for the appellant.
Mr. Anirudh Sharma, Advocate, for the respondents.
OMP No.854 of 2025
Heard counsel for the parties and perused the pleadings.
In the case at hand, plea is being raised by the applicants that the deposit made by the non- applicant/appellant in the case at hand is a short deposit. In order to support his contention, he has drawn the attention of this Court to the calculation sheet appended along with the reply filed by the non-applicant/appellant at page 145 of the paper book, specifically column No.13, wherein interest @ 15% has been calculated from 06.09.2014 to 20.01.2025.
Based on the aforesaid, the submission made by the applicants/respondents is that the deposit in the Court in pursuance to order dated 27.12.2024 has been made on 04.03.2025. Hence, he submits that interest should have been calculated not till 20.01.2025 but till
04.03.2025.
I see force in the submission made by the applicants/respondents. Let the shortfall so pointed out be
made good by the non-applicant/appellant within four weeks from today.
Insofar as the prayer for release of the compensation amount deposited in the Registry of the Court is concerned, the awarded amount in the case at hand pertains to acquisition of the properties of the applicants necessitated on account of construction of the National Highway. In my considered view, let 50% of the enhanced compensation amount deposited in the Registry of the Court along with proportionate interest accrued thereupon be released in favour of the applicants. The same be remitted in the bank accounts of the applicants, details whereof have been given in para 2 of the application, subject to proper verification of their identities. Application stands disposed of.
