Neutral Citation No. - 2025:AHC:112920 Court No. - 38 Case :- WRIT - A No. - 8427 of 2018 Petitioner :- Ramesh Chandra Verma Respondent :- State Of U.P. And 02 Others Counsel for Petitioner :- Shantanu Khare,Sr. Advocate Counsel for Respondent :- C.S.C. Hon'ble Donadi Ramesh,J.
1. Heard Shri Siddharth Khare, learned counsel for the petitioner and learned Standing Counsel for the State- respondents.
2. The present writ petition is filed questioning the order dated 12.03.2018 passed by the first- respondent compulsorily retiring the petitioner from service. In fact the respondents have passed an order by taking the punishment of censure awarded to the petitioner dated 20.06.2006, 21.12.2005 and 18.06.2014, as far as the above said punishments are concerned the petitioner has approached the Public Service Tribunal and the said orders were interdicted by Admn of the Public Service Tribunal in which the impugned order dated 18.06.2014 (Annexure No.11) is quashed the and other punishments are minor in nature and those are already worked out. Considering the said submissions this Court has passed an interim order on 22.03.2018, which reads as follows:-
"The petitioner has been compulsory retired by the impugned office order dated 12.03.2018. Sri Ashok Khare, learned Senior Counsel contends that although the service entries of the petitioner from 2007-08 till 2016-17 are excellent and that the entries of censor and that stoppage of increment awarded to the petitioner has been set-aside by the Tribunal and as such there was no material which could have permitted the petitioner to retire at an early date. Learned Standing Counsel appearing for the respondent may seek instructions and file counter affidavit within four weeks. Two weeks, thereafter, is allowed to the petitioner for filing rejoinder affidavit. List immediately for admission/ final disposal after expiry of the above period. Till the next date of listing, the operation of the impugned order 12.03.2018 shall remain in abeyance. "
3. By virtue of the above said order, the petitioner has continued
in the said post and retired on 31.03.2020 after attaining the age of superannuation. On instructions, learned counsel appearing on behalf of the petitioner has submitted that after retirement the respondents have released only basic pension and has not released the full pension and other post retirement benefits. Considering the said submissions, the present writ petition is
disposed of, without going into the merits of the case, as the petitioner has continued till 31.03.2020, based on the interim
order dated 22.03.2018. The impugned order dated 12.03.2018 is set aside and with a further direction to the respondents to consider and release all post retirement benefits including the pension, expeditiously.
