Irfan Siddiqui, learned counsel for the petitioner and learned AGA for the State. 2. This petition has been filed with the following prayer:- "i. in issue a writ, order or direction in the nature of Mandamus, by issuing directions to the opposite party no 1 transfer the investigation to any independent agencies for make proper, fair, impartial and effective investigation stipulated time in F.I.R. No.: 0165/2025, U/S:-80(2), 85, of B.N.S. & % 3/4 of D.P.Act. Police Station-Punchperwa, District- Balrampur on 21.08.2025 in the interest of justice, and also commanding the opposite party no.2 to arrest the accused persons forthwith as well as provide the security to the petitioner and his family member, the first information report is being annexed as Annexure No.-1 to this writ petition." 3. Learned counsel for the petitioner submits that the investigation of the case-in-question is not being conducted in impartial manner, therefore, the same may be transferred to some independent agency. 4. In view of above, without entering into the merit of the case, Versus Counsel for Petitioner(s) : Mohammad Irfan Siddiqui Counsel for Respondent(s) : G.A. Anwer Husain .....Petitioner(s) State Of U.P. Thru. Superintendent Of Police Bulrampur Dist. Balrampur And 2 Others .....Respondent(s) the petition is disposed of with liberty to the petitioner to move appropriate application before the Superintendent of Police, Balrampur in regard to the prayer made in this petition. In case, any such application is moved within two weeks from today, the same shall be considered and appropriate order shall be passed expeditiously.
