JUSTICE S VISHWAJITH SHETTY ORAL ORDER This is a successive bail application filed by accused No.2 in Spl.C.No.1/2023 pending before the Court of Principal District and Sessions Judge, Dakshina Kannada, Mangaluru, arising out of Crime No.54/2022 registered by CEN Crime Police station, Mangaluru City for offence punishable under Sections 21, 21(C), 27(b) of NDPS Act 1985. 2. Perusal of the material on record would go to show that petitioner had earlier approached this Court in Crl.P.No.8257/2023 which was dismissed on 20.03.2024 and in Crl.P.No.6950/2024 which was dismissed on 20.08.2024. This is the 3rd successive bail application now filed by the petitioner on the ground of delay in trial. 3. The material on record would go to show that petitioner has not approached the trial by filing similar bail application on the ground of delay in trial and on the other - 3 - HC-KAR NC: 2025:KHC:25224 CRL.P No. 1837 of 2025 hand, he has directly filed this petition before this Court raising the ground of delay in trial. 4. Therefore, petitioner is permitted to file a fresh bail application before the trial Court on the ground of delay in trial and in the event petitioner files such a fresh bail application before the trial Court, the said application shall be considered on merits and disposed of by the trial Court as expeditiously as possible.
