Heard learned counsel for the petitioners, learned Standing Counsel, who appears on behalf of State-opposite parties no.1 and 4 and Sri Namit Sharma, who appears on behalf of opposite parties no.2 and 3. 2. This writ petition has been filed praying for the following reliefs:- "Declare the impugned by-laws titled "Lucknow Nagar Nigam Deshi Sarab wa Videshi Sarab Kee Dukano Ko Niyamit Evam Nivantrit Kare Hetu Upvidhiyan, 1996" (1.e. Annexure No. 2), published in the U.P. Gazette on 29.03.1997, ultra vires the U.P. Municipal Corporation Act 1959. b. Issue a writ, order, or direction in the nature of mandamus directing the respondent No. 2 & 3 to forthwith cease and desist from demanding trade license fees, for both the foreign liquor shop as well as country liquor shop. from the petitioners for their composite retail liquor shops. c. Issue a writ, order, or direction in the nature of certiorari quashing the demand notices issued to petitioner nos. 1 (Annexure No.1) by the Respondent No.2." 3. Learned counsel for the petitioner prays that this writ petition may be dismissed as withdrawn with liberty to file a fresh petition.
