The contention of the petitioner's counsel is that the school which is mentioned at serial no.57 of the list appended to the document dated 01.07.2022 signed by the District Magistrate, Gonda has not been completely demolished, only partial demolition has taken place, and the school is being run in the remaining portion of the building which is dilapidated, thereby endangering the life of the students and teachers therein. It would be in the fitness of things, if the District Magistrate looks into the matter as to the decision taken for demolition, whether it is for partial demolition or complete demolition, and also, gets an on the spot inspection conducted to arrive at a conclusion with regard to the demolition and then implement such decision at the earliest, unless there is any legal impediment. It is made clear that we have not expressed any opinion as to whether the building is required to be demolished or not. This will have to be seen by the District Magistrate, unless already seen and decided, in which case decision would have to be implemented.
