Short affidavit of opposite party no. 2 and vakalatnama filed on behalf of opposite party no. 2 by Sri Rahul Srivastava, Advocate are taken on record. By means of the instant application, the applicant has sought the following main relief:- "(i) To quash entire proceedings of Complaint Case No. 1098 of 2012 under section 498A/323/504/506 I.P.C. P.S. Sarojini Nagar Lucknow (Smt. Poonam Verma Versus Anil Kumar Vimal and others) at present pending in the Court of learned Civil Judge (J.D.)/ F.T.C. Offences against Woman, Lucknow in the interest of justice." The aforesaid relief has been sought on the basis of the fact that the parties have settled their matrimonial dispute amicably outside of the Court and in terms of the settlement arrived in between the parties. The Criminal Case No. 202 of 2014 (Km. Anushka Vs. Anil Kumar Vimal) has already been decided. In this regard reference has been made in page 50 of the paper book, which is the copy of the order dated 07.02.2024 passed in Criminal Case No. 202 of 2014. The same is extracted hereinunder:- "पत्रावली आदेश हेतु प्रस्तुत हुयी । Versus Counsel for Applicant(s) : Virendra Mishra, Sant Lal Dixit Counsel for Opposite Party(s) : G.A. Anil Kumar Vimal And 2 Others .....Applicant(s) State Of U.P. Thru. Addl. Chief Secy. Home Lko. And Another .....Opposite Party(s) उभयपक्ष द्वारा सुलहनामा सी-40 दािखल िकया गया है। िजसमें उभयपक्षों द्वारा कथन िकया गया है िक उभय पक्षों के मध्य सुलह समझौता हो गया है । िजस कारण उपरोक्त वाद में अिग्रम कायर्वाही नहीं चाहते है । अतः सुलह समझौते के आधार पर वाद को िनस्तािरत िकये जाने की याचना की गयी है । इस सम्बन्ध में प्रािथनी कु मारी अनुष्का की संरिक्षका / माता पूनम वमार् एवं िवपक्षी अिनल कु मार िवमल द्वारा अपना अपना बयान भी न्यायालय के समक्ष उपिस्थत होकर अंिकत कराया गया है । सुलहनामा कागज संख्या सी 40 पर उभय पक्षों को सुना तथा पत्रावली का सम्यक रूप से पिरशीलन िकया। सुलहनामा कागज संख्या सी-40 पर प्रािथनी कु मारी अनुष्का की संरिक्षका / माता पूनम वमार् के हस्ताक्षर व फोटो की िशनाख्त उसके िवद्वान अिधवक्ता श्री राहुल श्रीवास्तव एवं िवपक्षी अिनल कु मार िवमल के हस्ताक्षर व फोटो की िशनाख्त उनके िवद्वान अिधवक्ता श्री सन्तलाल दीिक्षत द्वारा की गयी है। सुलहनामा उभय पक्षों की उपिस्थित में िदनांक-01.2.2024 को खुले न्यायालय में सत्यािपत िकया गया है। समस्त तथ्यों एवं पिरिस्थितयों को दृिष्टगत रखते हुए सुलहनामा कागज संख्या सी-40 के आधार पर प्रस्तुत वाद िनस्तािरत िकये जाने योग्य है। आदेश प्रस्तुत दािण्डक वाद संख्या-202/2014 कु मारी अनुष्का बनाम अिनल कु मार िवमल सुलहनामा कागज संख्या सी-40 के आधार पर िनस्तािरत िकया जाता है। सुलहनामा कागज संख्या-सी 40 िनणर्य मोरा का भाग होगा । बाद आवश्यक कायर्वाही पत्रावली िनयमानुसार दािखल दफ्तर हो।" It is also sated that in terms of the compromise annexed at page 51 of the paper book filed in Criminal Case No. 202 of 2014 as also the copy of cheque annexed at page 55 of the paper book would indicate that the amount settled between the parties has already been paid by the applicant no. 1. It is also stated that subsequent to the order dated 07.02.2024 based upon the settlement between the parties, the complaint case no. 324 of 2014 under Section 12 of the D.V. Act has also been decided vide order dated 14.02.2025 and opposite party no. 2 has also preferred an application dated 20.04.2024 duly supported by affidavit, where withdrawal of the complaint case no. 1098 of 2012 under Section 498-A, 323, 504, 506 of IPC has been filed. Opposite party no. 2 is present before this Court who has been identified by Sri Rahul Srivastava says that the proceedings be quashed based upon the compromise. The applicant no. 1 is also present and has been identified by Sri Sant Lal Dixit, learned counsel for the applicant. A482 No. 7350 of 2025 2 Accordingly, the entire proceedings of complaint case no. 1098 of 2012 under section 498A/323/504/506 I.P.C. P.S. Sarojini Nagar Lucknow (Smt. Poonam Verma Versus Anil Kumar Vimal and others) at present pending in the Court of learned Civil Judge (J.D.)/ F.T.C. Offences against Woman, Lucknow is hereby quashed.
