Vakalatnama filed by Shri Prabhat Dwivedi, Advocate on behalf of the respondent is taken on record. Heard learned counsel for the revisionist and learned counsel for the respondent. The present revision under section 19(4) of the Family Court Act, 1984 has been filed by the revisionist against the order dated 22.7.2024 passed by learned Additional Principal Judge, 05, Family Court, Lucknow in Criminal Case No.1249 of 2023, filed under Section 125 Criminal Procedure Code. In compliance of earlier order passed by this Court dated 16.10.2024, the parties are present before this Court, who have been identified by their counsels. It has been admitted by the revisionist that no amount of interim maintenance has been paid by him to respondent no.2 and he is not willing to pay the arrears. He is willing to pay the current interim maintenance amount only for referring the matter to the mediation. On the other hand, respondent no.2 has stated that first she should get the arrears and then she will give consent for mediation. Accordingly, the matter could not be sent for mediation for want of consent of respondent no.2. At this stage, learned counsel for the revisionist submits that the revision may be dismissed as not pressed. In view of the above, the revision is dismissed as not pressed. Let copy of this order be sent to learned trial court concerned, forthwith.
