[2025:RJ-JP:34444-DB] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR D.B. Civil Writ Petition (PIL) No. 6579/2025 Poonam Chand Bhandari Son of Late Rikhab Raj Bhandari, Aged About 72 Years, Resident of A-14, Malviya Nagar, Jaipur. ----Petitioner Versus 1. State of Rajasthan, Through Chief Secretary, Government of Rajasthan, Secretariat, Jaipur. 2. Law And Legal Affair Department, Government of Rajasthan, Secretariat, Jaipur Through Its Principal Secretary. ----Respondents For Petitioner(s) : None Present For Respondent(s) : Ms. Dhriti Laddha on behalf of Mr. Rajendra Prasad, Advocate General HON'BLE MR. JUSTICE SANJEEV PRAKASH SHARMA HON'BLE MR. JUSTICE SANJEET PUROHIT Order 28/08/2025 1. None appears for the petitioner. 2. The relief claimed in this Public Interest Litigation is as under: “(i) To direct respondents to take necessary and immediate action to frame objective evaluation system for appointing the Additional Advocate General and Government Counsels.” 3. We do not find that the aforesaid issue to be examined by us, as the appointment of Additional Advocate General and [2025:RJ-JP:34444-DB] (2 of 2) [CW-6579/2025] Government Counsels is in the exclusive administrative domain of the State Government. 4. We noticed that there are no specific Rules or Regulations framed for the appointment of Additional Advocate General and Government Counsels in the High Court. While there is a public prosecution process adopted where the Public Prosecutors-cum- Assistant Public Prosecutors are appointed by way of Rules framed under Article 309 of the Constitution of India. The appointment of Additional Advocate General and Government Counsels apparently in the High Court is not statutory or an appointment of a post in the strict census and is only for the purpose of representing the Government in cases like any other lawyer being appointed for contesting a case. 5. We, therefore, need not interfere in the matter. The present Civil Writ Petition (PIL) is accordingly, dismissed. 6. Pending application(s), if any, stand disposed of.
