Mr. B.S. Koranga, learned counsel for the applicant. 2. Mr. G.S. Sandhu, learned Additional Advocate General with Mr. Deepak Bhardwaj, learned Brief Holder for the State. 3. The present applicant ‘Kuldeep @ Vijay Joshi @ Farishta S/o Heera Ballabh Joshi is praying for bail in reference to First Information Report dated 22.02.2025 bearing FIR No. 0008 of 2025 P.S. Rithasahib, District Champawat, wherein, the present applicant along with one Maang Singh @ Maan Singh @ Mangu have been implicated for the offence punishable under Section 2/3 of U.P. Gangsters and Anti Social Activities Prevention Act, 1986. 4. It is argued by the learned counsel for the applicant that on the basis of the case, the reference of which has been given in paragraph 6, the applicant has been implicated under the Gangsters Act though in most of the cases the applicant is already bailed out; however, in three cases he has been convicted by imposing fine. 5. A detail counter affidavit has been filed and there is no any denial with regard to the facts that the applicant in most of the cases is already bailed out. 6. After hearing the arguments of learned counsel for the parties and further taking into consideration that in all the previous cases the applicant is already bailed out though in some cases he was convicted, this court is of the view that the applicant deserves for bail. 7. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed. 8. Let the applicant ‘Kuldeep Joshi @ Vijay Joshi @ Farishta be released on bail on furnishing his personal bond and two sureties 2025:UHC:10233 each of the like amount to the satisfaction of the court concerned.
