The present writ petition has been filed seeking the following reliefs:- (i) To issue a writ in the nature of Certorari/Mandamus or any other appropriate writ/directions/orders, direction to quash and set aside the impugned Order No. DAB- 5/2/2022-EDN(S)-EDN(S) dated 05th August, 2024 (Annexure-A/13) issued by the Under Secretary (Education-S), Government of Manipur and consequent impugned Order No. EST5-2/4/2024-EDN(S) dated 23rd August, 2024 (Annexure-A/15) issued by the under LUCY GURU MAYU M Digitally signed by LUCY GURUMAYUM Date: 2025.08.25 15:55:21 +05'30' 2 Secretary, Education (S), Government of Manipur, in the facts and circumstances of the present petition; (ii) To issue a writ in the nature of Certiorari/ Mandamus or any other appropriate writ/directions/orders, direction to review/rectify/modify the impugned Notification bearing No. 12(HC)/125/2023-SE(S) dated 29th July, 2024 (At Annexure-A/11) issued by the Under Secretary, Education (S), Government of Manipur, in the facts and circumstances of the present petition; (iii) To issue a writ in the nature of Mandamus/Certiorari/or any other appropriate writ/directions/orders, direction to consider the dispose of the objection application dated 14.08.2024 (At Annexure- A/12) submitted by the petitioner by issuing a reason and speaking order, in the facts and circumstances of the present case. So far as the relief sought for in prayer no. 4 is concerned, it has been submitted at the Bar that after considering the objection filed by the concern officers including the present petitioner, the impugned tentative seniority list has been finalized by the State Government by issuing final seniority list dated 11.09.2024 of the Assistant Engineer in the Engineering Wing of the Education(S) Department, Government of Manipur and as such, no caused survive for adjudication with regard to prayer no. 4. With regard to relief sought for in prayer no. 5 is concerned, it has been submitted at the Bar that objection dated 3 27.08.2024 submitted by the petitioner against the impugned tentative seniority list dated 29.07.2024 had been duly considered by the authorities and thereafter the final seniority list has been published and as such, with regard to prayer no. 5 also no caused survive for adjudication. With regard to relief sought for in prayer no. 3, it has been submitted by the learned GA that both the impugned orders which allowed the respondent no. 5 to hold the charge of Superintendent Engineer has been superseded by the government by issuing order dated 11.09.2024 and as such, with regard to the said prayer no. 3 also no caused survive for adjudication. The learned GA accordingly submitted that in view of the above position, the present writ petition can be closed as infructous.
