HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW PUBLIC INTEREST LITIGATION (PIL) No. - 915 of 2025 Court No. - 1 HON'BLE RAJAN ROY, J. HON'BLE MANJIVE SHUKLA, J. 1. Heard learned counsel for the petitioner, learned Standing Counsel for the State and Sri Suyash Dwivedi, learned counsel for opposite party no.5. 2. Petitioner alleges that a school is being run on pond land bearing Gata No.665 (New Gata no.350) whereas learned Standing Counsel has instructions that school is not being run on old Gata no.665 as, during consolidation out of original Gata No.665, three new gatas bearing Gata nos.350Ka, 350Kha and 350Ga were formed. The pond exists only on Gata No.350Ga and school is being run on the other newly carved out gatas. 3. We cannot go into such disputed questions of fact. Petitioner, if there is a cause, can avail other remedies, however, before doing so, he should go through the decision of Hon'ble the Supreme Court in the case of 'Jagpal Singh & Ors. vs. State of Punjab & Ors.' reported in AIR (2011) SC 1123. 4. Accordingly, the writ petition is disposed of. September 2, 2025 Shanu/- Versus Counsel for Petitioner(s) : Kuldeep Counsel for Respondent(s) : C.S.C. (Manjive Shukla,J.) (Rajan Roy,J.)
