Instant petition has been filed praying for a mandamus commanding the respondent no.2 to re-fix the pay scale of the petitioner in accordance with the 5th and 6th Pay Commission including all admissible ACP related benefits and to consider the representation of the petitioner pending before respondent no.2. 3. A preliminary objection has been taken by Sri Aditya Mohan, learned counsel for respondents no.2 and 3, that the claim of the petitioner has already been rejected vide order dated 24.01.2025, a copy of which is Annexure-1 to the petition, which order has not been challenged by the petitioner. 4. Considering that the claim of the petitioner has already been rejected and no challenge has been raised to the same as such the writ petition is dismissed leaving it open to the petitioner to challenge the said order before appropriate Court in appropriate proceedings.
