Heard learned counsel for petitioner and learned state counsel for opposite parties. 2. Petition has been filed seeking following prayers:- " i. Issue a writ, order or direction in the nature of mandamus commanding the opposite parties to promote the Petitioner from Medical Officer in Level-II (Grade Pay 6600, Pay Scale-67,700-2,08,700, Level-11) to Consultant in Level- III (Grade Pay 7600, Pay Scale- 78,800-2,09,200, Level-12), w.e.f. the date person juniors to the petitioners (i.e. 10.02.2022) have been promoted to Consultant in Level-III (Grade Pay 7600, Pay Scale- 78,800-2,09,200, Level-12), in Provincial Medical and Health Services, Uttar Pradesh, with all consequential service benefits, including arrear of salary, etc, along with interest upon the same, forthwith." 3. Since petitioner's grievances would require consideration of factual aspects, liberty is granted to petitioner to make a fresh representation before opposite party No. 1 i.e. Additional Chief Secretary, Department of Medical, Health and Family Welfare, Government of U.P., Lucknow or any other competent authority. In case such a representation is filed, the same is required to be decided within a period of eight weeks from the date a certified copy of this order is produced before the said authority. 4.
