Heard Sri K.G. Krishna Murthy, learned Senior Counsel 2. assisted by Sri K. Raghu Veer, learned counsel for petitioners in W.P.No.5186 of 2024, Smt. Kavitha Gottipati, learned counsel for petitioners in W.P.Nos.29707 of 2024 & 10452 of 2025, and learned Government Pleaders for Services-I & II appearing for respondents. This Court, on 26.03.2025, passed the following order in 3. W.P.No.5186 of 2024: “Sri K.G. Krishna Murthy, learned senior counsel, appearing on behalf of the petitioners, would submit that this Court in W.P.No.25660 of 2020 directed the respondents to consider the names of petitioners for promotion to the post of Agricultural Officer in Zone-IV. After passing of aforesaid order on 10.08.2021, after much persuasion and filing Contempt Case, on ad hoc basis, promotion orders were issued to the petitioners on 06.03.2023. He submits that petitioners ought to have been promoted with reference to the panel year 2020- 2021. The provisional seniority, which has been circulated by memo, dated 17.04.2024, though places the petitioners at SI. Nos. 18 and 19, they are supposed to be considered for promotion basing on seniority list as existed for the panel year 2020-21. 2. According to the learned senior counsel, for the panel year 2020-21, there were about 14 vacancies and petitioners were entitled to be considered for the said vacancies. He placed reliance on the judgment rendered by the Hon’ble Apex Court in Y.V. Rangaiah v. J.Sreenivasa Rao : [(1983) 3 SCC 284], to contend that promotions have to 6 CGR,J W.P.NOS.5186S29707 of2024&104S2 of 2025 be effected with reference to the vacancies arising in a particular panel year. He also placed reliance on the order in P.Nageswara Reddy v. Govt. ofA.P.: (W.P.No.476 of 2021, dt.03.02.2023), by which a co-ordinate Bench of this Court held that only after finalizing year-wise panels, entitlement of petitioners therein for promotion to be given effect. 3. Learned Government Pleader for Services-ll seeks time to place on record the seniority list as existed for the panel year 2020-21, which would make clear whether the petitioners claim for seniority was within zone of consideration or not. 4. List on 02.04.2025. 4. Thereafter, on 26.06.2025, the following order was passed; "This Court In W.P. No. 25660 of 2020 while considering the claim of petitioners for promotion has specifically dealt with the effect of Rule 6(b) of the Andhra Pradesh State and Subordinate Service Rules, 1996, and held that candidates who have subsequently passed the tests acquired qualification for inclusion in the panel of that year, their names can also be considered after a period of six months from the date of approval. 4s petitioners stated to have acquired the qualification of B.Sc. (Agriculture) preparation of provisional seniority list, this Court finally concluded that petitioners were entitled to be considered for promotion to the post of Agriculture Officer in Zone-IV. It is stated that no such exercise has been conducted after publishing the provisional seniority list and as seen from the memo dated 24.06.2025, filed by the respondents, seniority list communicated appears to be only provisional Ir nature, but not, final seniority list.
