The present applicant-Sameer Ali, S/o Yunus is praying for bail in reference to FIR dated 12.10.2025, bearing FIR No.1002 of 2025 registered at P.S. Kotwali Laksar, District Haridwar, wherein, the present applicant has been implicated for the offence punishable under Section 8/22 of the Narcotic Drugs and Psychotropic Substances Act, 1985. 4. Learned counsel for the applicant submits that the present applicant is innocent and has been falsely implicated and the alleged prohibited drug which is shown to be recovered is a non commercial quantity and there is no substantial compliance of Sections 42, 50, 52A, 55 and 57 of the NDPS Act. He further submits that the applicant has no previous criminal history. 5. On the other side, Ms. Minakshi Sharma, learned Brief Holder has not disputed that the alleged prohibited drug which is shown to be recovered is a non commercial quantity. 6. After hearing the arguments of learned counsel for the parties and taking into consideration that the alleged recovered prohibited drug is non commercial quantity and furthermore, the applicant has no previous criminal history, this Court is of the view that the applicant deserves for bail. 7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 8. Let the applicant-Sameer Ali be released on bail on his executing a personal bond and furnishing two reliable sureties each of the like amount to the satisfaction of the court concerned.
