ORDER 29.08.2025 Heard Mr. A. Paramanik, learned counsel for the petitioner and Mr. R. J. Baruah, learned Addl. P.P., Assam for the State. By this application filed under Section 483 of the BNSS, 2023 the petitioner, viz., Manik Mandal has prayed for bail in connection with Chhaygaon P.S. Case No.179/2025 registered under Sections 108/80 of the BNS.
Page No.# 2/3 The F.I.R. dated 08.06.2025 lodged by the father of the victim reveals that the petitioner and the victim had a love relationship and both of them were staying together since a year and that on 08.06.2025 the victim had committed suicide by hanging in her living room. The informant further stated that the petitioner had tortured the victim by demanding dowry. Mr. A. Paramanik, learned counsel for the petitioner submits that the actual
facts in the instant case is that the victim was not desiring to continue her conjugal life with the joint family of the petitioner and as such quarrel used to take place between them for which she finally committed suicide. Mr. R. J. Baruah, learned counsel for the State submits that the complainant in his statement had stated that dowry was demanded by the petitioner from the victim but apart from the said statement none of the other witnesses had stated about dowry nor stated about the physical torture although some of them had stated that they had heard quarrel taking place between them. The learned Additional P.P. further submits on perusal of the Case Diary that the medical report of the deceased shows that it is a case of hanging and not strangulation. In view of the submissions made above and on perusal of the Case Diary this Court deems it fit that the petitioner may be released on bail on furnishing a bail bond of Rs.20,000/- with one local surety to the satisfaction of the learned Chief Judicial Magistrate, Kamrup, Amingaon under the following conditions :-
Page No.# 3/3 (1) That the petitioner shall cooperate with the investigation and shall appear before the I.O. as and when called for. (2) That the petitioner shall not tamper with the evidence and shall not influence the witnesses connected with the case. (3) That the petitioner shall not leave the jurisdiction of the learned Chief Judicial Magistrate, Kamrup, Amingaon without the leave of the Court. The Bail Application stands disposed of.
