Mr. Harshit Sharma, Advocate, vice Mr. Janesh Gupta, Advocate, for respondent No.2. Name of respondent No.3 stands deleted vide order dated 03.12.2021. None for respondents No.4, 6 and 7. Appeal stands abated against respondents No.5, 8 and 9. CMP No.14892 of 2025 No reply is intended to be filed on behalf of non-applicants. The non-applicants have no objection, if in case the application is allowed and the name of deceased respondent No.1, i.e. Trilok Singh, is ordered to be deleted, as is being sought in the present application. Respondent No.1 is stated to have died during the pendency of the appeal. As per the applicant, respondent No.1 is survived by his legal heir, who is already on record as respondent No.2. In fact, according to the applicant, respondents No.1 to 3 were the co-plaintiffs. Their interests were common in the joint property. Respondent No.1 was the brother of respondent No.2 and respondent No.3 was the mother of respondents No.1 and 2. In view of the aforesaid, present application is allowed. Name of respondent No.1 is ordered to be deleted from the array of the parties, subject to just all exceptions. Amended memo of parties be filed within a period of one week.
