BEFORE HONOURABLE MR. JUSTICE SOUMITRA SAIKIA ORDER 25.07.2025 Heard Mr. I.H Saikia, learned counsel for the petitioner. Also heard Mr. S Dutta, learned counsel for the respondent No. 2. Page No.# 3/4 This interlocutory application has been filed for impleadment of opposite party No. 3 as contemnor No. 3 in contempt Case No. 259/2025. It is submitted by the learned counsel for the applicant that the opposite party is presently holding the post of Additional Chief Secretary to the Government of Assam, Revenue and Disaster Management Department, Assam and the said opposite party has also not complied with the directions contained with the order dated 03.10.2024 and therefore the opposite party is also required to be arrayed as party respondent. Mr. S Dutta, learned counsel appearing for the contemnor No. 2 does not object to the prayer made. None appears for the contemnor No. 1.
Accordingly, this Court is of the view that since the directions contained in the order dated 03.10.2024 passed in W.P(C) No. 4847/2024 has not been complied with and the opposite party is now holding the Office which was earlier held by the contemnor No. 1, this Court is of the view that the opposite party is a necessary party and is required to be arrayed as party respondent in the present proceedings. Since notices will be issued on the opposite party and they will get opportunities to respond in the contempt petition, the order of impleadment is passed today at this stage without issuing notice in the interlocutory application. The interlocutory application accordingly stands disposed of. The opposite party No. 3 be arrayed as contemnor No. 3 in the
Page No.# 4/4 contempt Petition No. 259/2025. The interlocutory application accordingly stands allowed and disposed of. The applicant will file amended cause title before the Registry from one week from today. Copy of the order passed in the interlocutory application shall be kept in the case record of the Contempt Case No. 259/2025. JUDGE Comparing Assistant
