When this case was called out in the first round, pass over was sought by an associate of learned counsel for the petitioner on the ground that he is in traffic jam. On his request the case was directed to be taken up at 12.00 noon, but no one is present on behalf of the petitioner, at 12.00 noon, when the case is called, whereas learned A.G.A. is present. Learned A.G.A. has raised a preliminary objection that this petition before this court is not maintainable for the reason that the history sheet of the petitioner has been opened bearing No.98-A at Police Station-Jhangaha, District-Gorakhpur, which is under challenge in this petition. So far as the prayer No.2 for a direction for disposal of representation is concerned, he submits that the Additional Chief Secretary (Home), State of U.P. is not to consider the request of the petitioner in regard to the history sheet. Even otherwise merely by moving a representation, which is not statutory in nature, the jurisdiction cannot be made out. Having considered the submissions of learned A.G.A. and going through the contents of the petition, this court find force in the submission of learned A.G.A.
