Hon'ble Prakash Padia,J. 1. Heard learned counsel for the petitioner and perused the record. 2. The basic relief sought by the petitioner in the present petition is to direct the respondent no. 2 to appoint the petitioner in the place of her husband as per her qualification under dying in harness rules. 3. The instructions dated 10.02.2025 under the signatures of respondent no. 2/Commandant 20vi Vahani P.A.C. Azamgarh (U.P.) placed before this Court by learned Standing Counsel, the same is taken on record. 4. The following objections were raised against the petitioner in the aforesaid instructions:- "4. यह ककी ममृतक आशश्रित ससेववाययोजन ननयमवावलली 1974 मम उनल्लिशखित नवशधि व्यवस्थवा कसे अननुरूप ननधिवार्धाररित पवारूप मम यवाचली दवारिवा पसेनषित अपनसे आवसेदन पत्र कसे सवाथ ममृत सरिकवारिली ससेवक कसे कनु टनुम्ब कसे वयस्क सदस्ययों कवा शपथ पत्र / सहमनत-पत्र उनकसे पक्ष मम शजन्हसे ससेववाययोजन नदलवानवा चवाहतसे हयों , पस्तनुत नहहीं नकयवा गयवा हहै। 5. यह नक स्व० टसेलरि मनु० इरिफवान कसे चररित्र पपंशजकवा मम नवानमनली कसे स्थवान परि नकसली कवा नवाम अपंनकत नहहीं हहै। (सपंलग्नक-1)" 5. Learned Standing counsel also placed before this Court a letter dated 19.12.2024 written by respondent no. 2 to the Senior Superintendent of Police, Gorakhpur, by which certain papers and documents were sought for by him. It is argued that unless and until the petitioner will place the necessary papers and documents before the authorities, it is not possible for them to take a decision in the matter. 6. Heard counsel for the parties and perused the record. 7. In the facts and circumstances of the case, the present petition is disposed of directing the petitioner to provide all necessary papers and documents as has been sought for by the respondents within a month from today, if it so, the respondents will pass necessary orders in the matter within three months. 8. Needless to say that the orders will be passed strictly in accordance with law and after providing opportunity of hearing to all the parties concerned.
