HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 8238 of 2025 Court No. - 13 HON'BLE SUBHASH VIDYARTHI, J.
1. Heard Sri Manoj Kumar Singh, the learned counsel for the applicant as well as Sri Mayank Sinha, the learned A.G.A. for the State and perused the records. 2. The instant application has been filed seeking release of the applicant on bail in Case Crime No. 143/2020, under Sections 409, 420, 467, 468, 471, 120-B I.P.C, Police Station Gomti Nagar, District Lucknow. 3. The aforesaid case has been registered on the basis of an F.I.R. lodged on 19.01.2020 against six persons, including the applicant, stating that the informant had made investment in Shine City Infra Project Pvt. Ltd. and it was promised that he will be transferred a developed plot of land but no benefit was given to the informant on the investment. 4. In the affidavit filed in support of the bail application, it has been stated that the applicant is innocent, he has been falsely implicated in the present case because he used to work as an agent for the company. 5. The learned AGA has opposed the prayer for bail and he has submitted that the investigation in the matter is still going on. 6. A supplementary affidavit has been filed on behalf of the applicant stating that all the six criminal cases are similar in nature and in three of which, the applicant has been granted bail. Versus Counsel for Applicant(s) : Manoj Kumar Singh, Kunwar Prithvi Tomar Counsel for Opposite Party(s) : G.A. Tejnarayan Shukla .....Applicant(s) State Of U.P. Thru. Prin. Secy, Home Lko .....Opposite Party(s)
7. The learned counsel for the applicant has submitted that two co- accused persons, namely, Amitabh Kumar Srivastava and Meera Srivastava, have been granted bail and copies of their bail orders have been annexed as Annexure No. 2 and 3 of the affidavit filed in support of the bail application. 8.
Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the FIR alleges non-return of benefits in respect of the investment made in a company; the applicant was merely working as an agent in the company and he was neither director nor any principal position holder in the company, coupled with the fact that the applicant is languishing in jail since 23.07.2025 whereas the investigation already stands concluded and that two co-accused persons have already been granted bail, I am of the view that the applicant is also entitled to be released on bail. 9. Accordingly, this bail application stands allowed. 10. Let the applicant- Tejnarayan Shukla be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to the following conditions: - (i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses; (iii) the applicant shall appear on each and every date fixed by the trial court.
