HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 8594 of 2025 Court No. - 6 HON'BLE PANKAJ BHATIA, J.
1. The present petition has been filed challenging the order dated 30.06.2025, whereby a complaint made by the petitioner was rejected mainly on the ground that the petitioner is neither a member of the Society and is thus an outsider, and as such, the complaint was not maintainable. 2. The submission of the learned counsel for the petitioner is that the petitioner was a member of the Society, but his membership was terminated without following the due process of law, which was also stated by the petitioner in his rejoinder affidavit. Considering the fact that the first grievance of the petitioner was that his removal was without any authority of law and the second grievance was that various irregularities were being committed in the Society, the only remedy available to the petitioner was to file a civil suit for the restoration of his membership, which has not been done. 3. In view of the admitted fact that the petitioner was not a member of the Society on the date of the filing of the complaint, no fault can be found in the impugned order dated 30.06.2025. The petitioner is at liberty to prefer a civil suit for the restoration of his membership, if so advised. 4. The counsel for the petitioner relies on the judgment of this Court in T.P. Singh vs. Registrar/Assistant Registrar, Firms Societies and Chits, Teliyerganj and Others, wherein it was held that where Versus Counsel for Petitioner(s) : Alok Kr. Misra Counsel for Respondent(s) : C.S.C., Azad Khan Ajeet Kumar Pandey .....Petitioner(s) State Of U.P. Thru. Its Addl. Chief Secy. Deptt. Of Higher Education Lko. And 2 Others .....Respondent(s)
there is an alteration in the list of members affected under Section 4(B), it is the duty of the Deputy Registrar to examine the facts and verify them, the non-exercise of the said power would not be a proper exercise of power. However, the said judgment is of no help to the petitioner's case, as the petitioner has been removed, and his removal was not even challenged, nor can it be challenged before the Deputy Registrar under any statutory provision specified under the Societies Registration Act. 5. With the aforesaid observation, this petition is disposed of. 6.
The order has been passed in the presence of Shri Alok Kumar Tripathi, Advocate, appearing for the opposite party no. 3. September 8, 2025 Haseen U.
