Heard Mr. N.J. Gogoi, learned counsel for the applicants and Mr. J. Kalita, counsel for the opposite party.
2. This interlocutory application is preferred by the applicants, for directing the opposite party to deposit 50% of the awarded amount.
3. Mr. Gogoi, learned counsel for the applicants submits that in connection with one interlocutory application, being I.A.(Civil) No. 1679/2024, the impugned order dated 21.03.2024, was stayed. But, while passing the said order no direction was issued to the opposite party to deposit 50% of the awarded amount and therefore,
Page No.# 3/3 this IA has been preferred for directing the opposite party to deposit the same.
4. Taking note of the submission of learned counsel for both the parties and also considering the facts and circumstances on the record, it is provided that the opposite party shall deposit 50% of the awarded amount before the Registry of this court, within a period of 4 (four) weeks from today and such deposit being made, the applicants are at liberty to withdraw the same.
5. In terms of above, this I.A. stands disposed of.
