Though the application under Section 528 of BNSS has been preferred by the applicants for quashing the Charge Sheet dated 21.07.2011 and cognizance/ summoning order dated 06.08.2011 passed by Judicial Magistrate, Kasya Kushi Nagar and N.B.W. dated 13.11.2024 passed by Special Judge, SC/ST Act in Case Crime No. 164 of 2011, under Sections 452, 323, 504, 506 IPC, and 3 (1)(X) of SC/ST Act, Police Station- Ahirauli Bazar, District Kushi Nagar but the learned counsel for the applicant has confined the relief only for a direction for consideration of the bail / discharge application application before the court below with expedition. 3. Learned A.G.A. has no objection to the same. 4. Considering the submissions raised at the Bar and the statements so sought to be made by them, the application stands consigned to record while observing that in case appropriate proceeding in the form of bail/ discharge application is preferred before the court below, then the same shall be decided with most expedition strictly in accordance with the law of the land keeping in view the judgment in the law of land.
