Neutral Citation No. - 2025:AHC-LKO:575 Court No. - 17 Case :- CONTEMPT APPLICATION (CIVIL) No. - 3808 of 2024 Applicant :- Ram Charan Bharti Opposite Party :- Dr. Manvendra Pratap Singh, Director, Ayurvedic Services, Lko. And Another Counsel for Applicant :- Pradeep Kumar Shukla Hon'ble Manish Kumar,J. Compliance affidavit filed by respondent no. 2 is taken on record. Learned Standing Counsel has submitted that in compliance of the
judgment and order dated 04.07.2024 passed in Writ A No. 3647 of 2024, the amount of Rs. 5,92,506/- which was deducted while making payment of post retiral dues to the applicant has been refunded by crediting the same in the account of the applicant on
21.12.2024. On the other hand, learned counsel for the applicant has submitted that though the amount which was deducted has been credited in the account of the applicant but the pay fixation which was erroneously been made has yet not been corrected or refixed. The said submission of learned counsel for the applicant is not tenable as in the representation dated 23.7.2024 made by the applicant to the Director, he had nowhere disputed the pay fixation or refixation of his salary by giving reasons for the same in his representation. After arguing at some length, learned counsel for the applicant has submitted that otherwise for all practical purposes, the judgment and order passed by the writ Court has been complied with, as such, the present contempt petition has become infructuous and the same may be dismissed as infructuous but liberty may be given to the applicant to raise his grievance, if any, before appropriate authority. In view of above, the present contempt application is dismissed as infructuous with liberty to the applicant to avail the remedy, as may be permissible under the law. Notice, if any, stands discharged.
