This writ application has been filed by the petitioners for a direction to the opposite party no.1-the Collector-cum-District Magistrate, Jajpur to stop the construction of drain work for discharge of waste water to Gochar land bearing Plot No. 2711, Mouza-Nanpur of Balichandrapur Gram Panchayat under the Tahasil-Darpan in the District of Jajpur which is adjacent to the petitioners’ residential house. 2. Perusal of the writ petition does not reveal any averment or any document that the petitioners are the recorded owners of Plot No. 2697, 2698, 2699 and 2710. Hence no direction can be issued at their instance to the authorities. 3. Mr. B.K. Sahoo, learned counsel for the petitioners submits that the petitioners in fact are the recorded owners of Plot No. 2697, 2698, 2699 and 2710 but inadvertently averment to that effect has not been made nor supporting documents filed in the writ petition. 4. In view of the submission that some of the villagers of village Nanpur under Balichandrapur Gram Panchayat have taken steps for discharge of waste water to the Gochar land bearing Plot No. 2711, this writ petition is disposed of, granting liberty to the petitioners to file a representation before the Tahasildar, to enquire into the allegation and take action in accordance with law.
