Mr. Rakesh Kunwar, learned counsel holding brief of Mr. Shivanand Bhatt, learned counsel for Respondent no.2. 4. Present application has been filed by the applicant under Section 482 of Cr.P.C. alongwith compounding application and the same is supported with the affidavits of applicant and respondent no.2. 5. By means of this C482 application, applicant has sought quashing of the charge sheet dated 01.10.2019, summoning order dated 12.12.2019 as well as the entire proceedings of Criminal Case No.6692 of 2019 (Crime No.146 of 2019) State vs. Hari Om Joshi, for the offence punishable under Sections 498A, 323, 504 & 506 IPC and Section 3/4 of Dowry Prohibition Act registered at Police Station Nehru Colony, District Dehradun pending in the court of learned Additional Chief Judicial Magistrate, 5th Dehradun, District Dehradun. 6. Today the matter is listed for the report of the Secretary, DLSA, Dehradun. 7. In the order sheet dated 19.09.2025 whereby this Court had noted that joint statement made on behalf of learned counsel for the parties that since the applicant stays in Hyderabad due to his vocation and that respondent no.2 lives in Dehradun with a minor child of about 10 years, it may be difficult for respondent no.2 to make a representation in person before this Court; considering the same this Court have passed direction for both the parties to appear before the Secretary, DLSA, Dehradun taking in view the convenience of respondent no.2 and further it was observed that the applicant may also join her. 8. Today, the parties are being represented by their learned counsel and a report in this regard is being submitted by learned Secretary, DLSA, Dehradun i.e. paper no.53. The report of the Secretary, DLSA, Dehradun details as that the applicant and respondent no.2 relating to Criminal Misc. Application under Section 482 No.832 of 2022 Hari Om Joshi vs. State of Uttarakhand and another appeared before the Secretary, DLSA, Dehradun on 08.10.2025. As per the report of the Secretary, DLSA, Dehradun, it is clear that the parties have come into the terms of compromise and in the interest of justice the matter shall be decided accordingly. 9. Learned counsel for the parties have filed their respective affidavits along with the compounding application stating therein that they do not wish to pursue the present criminal case any further and a compromise has been entered between them. 10. Learned State counsel has opposed the compounding application and submits that some of the offences are not compoundable. 11. Heard learned counsel for the parties and perused the material available on record. 12. In view of the principle of law laid down by Ho’ble the Apex Court in the case of Gian Singh vs. State of Punjab reported in 2012 (10) SCC 303, criminal proceedings can be quashed by this Court, if this Court is satisfied that matter has been settled between the parties amicably and parties are interest to restore peace and harmony between them. 13. Having heard learned counsel for the parties and in view of the above, the compounding application is allowed. The entire proceedings of Criminal Case No.6692 of 2019 (Crime No.146 of 2019) State vs. Hari Om Joshi, for the offence punishable under Sections 498A, 323, 504 & 506 IPC and Section 3/4 of Dowry Prohibition Act pending in the court of learned Additional Chief Judicial Magistrate, 5th Dehradun, District Dehradunare are hereby quashed. 14. Accordingly instant Criminal Misc. Application stands disposed of.
