(2) Petitioner is serving as Deputy Manager, HR in Bharat Heavy Electricals Lim ited, Ranipur, Haridwar. Punishment of withholding one increment without cumulative effect was imposed upon him vide order dated 24.6.2025, passed by DGM, HR. Petitioner filed appeal against the said order, which is addressed to AGM, HR. Since no decision is taken on the appeal, therefore, petitioner has approached this Court challenging the punishm ent order as well as the report subm itted by the Internal Complaints Committee.

Learned Counsel for the petitioner submits that although appeal was filed by the petitioner well within tim e and the same was addressed to the competent authority, however the AGM, HR, vide e-mail dated 10.10.2025, informed the petitioner that the appeal would not be cognizable by him.
(4) Mr. Birendra Singh Adhikari,
learned Counsel appearing for the BHEL, on instructions, however subm its that due to some confusion, that e-mail was sent to the petitioner, however, he has instructions to state that AGM, HR is the competent authority to hear the appeal, to whom the appeal was addressed. He assures that the appeal would be decided on m erits as early as possible.

Learned Counsel for the petitioner then submits that relevant documents, which were relied upon by the punishing authority for imposing the penalty have not been supplied to the petitioner despite repeated requests. This, according to
learned Counsel, has prevented the petitioner from effectively defending himself.
(6) Mr. Birendra Singh Adhikari submits that if the request made by the petitioner for supply of documents is pending before the disciplinary authority, then disciplinary authority shall pass appropriate order on petitioner’s request within one week from the date of presentation of certified copy of this order.
(7) It shall be open to the petitioner to file additional grounds of appeal within one week from the date of supply of such documents. Appellate authority shall consider and decide petitioner’s appeal within six weeks thereafter.
(8) With the directions aforesaid, writ petition stands disposed of.
