Heard learned counsel for the petitioner, learned Standing Counsel for the respondents-State No.1 & 2 and Shri Prashant Kumar Singh, learned counsel appearing for respondents No.3 to 5. 2. With the consent of the parties, the matter is being decided finally. 3. Contention of the learned counsel for the petitioner is that despite the petitioner having retired on 31.07.2023, having been regularized vide order dated 09.03.2005 and the regularization order itself indicating that he would be entitled to all the benefits as applicable to the regular employees of the University yet the respondents have failed to give pension and other retiral dues to the petitioner as per the Old Pension Scheme. 4. Responding Shri Prashant Kumar Singh, learned counsel for the respondents-University states that the matter pertains to Old Pension Scheme and is to be considered by the State Government i.e. respondent No.1. 5. Considering the aforesaid the writ petition is disposed of with a direction to the respondent No.1 to consider the claim of the petitioner for grant of benefit under Old Pension Scheme in accordance with law under relevant rules which order shall be passed within a period of 6 weeks from the date of receipt of a certified copy of this order.
