CORAM : HON’BLE MR. JUSTICE DEEPAK ROSHAN ------ For the Petitioner(s) : Mr. Rajesh Kumar, Advocate For the State : Mrs. Shweta Singh, A.P.P. ----- 02/ 05.06.2025
Heard learned counsel for the parties.
2.
This anticipatory bail application has been filed by the petitioners apprehending their arrest for offences under Sections 467, 468, 469, 471 and 420 IPC.
3.
Learned A.P.P. representing the State opposes the prayer for anticipatory bail.
4.
There is an allegation against the petitioners of taking money from the complainant by cheating on the pretext of sale of land and thereafter not returning the money.
5.
Admitted fact is that the case arises out of a complaint. In a complaint case, there is no question of custodial interrogation. The only fact which the Court has to be assured of is whether the accused will face the trial or not or whether there is any chance of tampering with the evidence.
6.
The impugned order does not suggest any of the aforesaid situation. Thus, in a complaint case, since there is no

necessity of custodial interrogation, I am inclined to release this petitioners on anticipatory bail.
7.
With the aforesaid observation, this Anticipatory Bail Application stands allowed. The petitioners, above named, are
directed to surrender before the learned court below within a period of four weeks and on the event of their surrender or arrest, they shall be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Lohardaga, in connection with Complaint Case No.573 of 2021, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
