ANJARIA and HON'BLE MR JUSTICE M.I.ARUN - 3 - NC: 2025:KHC:10912-DB CCC No. 144 of 2024 ORAL JUDGMENT (PER: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA) Heard learned advocate Mr. K.R. Ganesh Rao for the complainant and learned advocate Mr. T.P. Muthanna for the respondents-Canara Bank and its authorities. 2. The operative part of the order dated 18.04.2023 passed by learned Single Judge while allowing Writ Petition No.13887 of 2020 reads as under, "(i) Writ petition is allowed. (ii) The impugned order dated 30.11.2018, passed by the 1st respondent herein (Annexure-Q), order dated 30.11.2018 and order dated 11.07.2019 passed by the 2nd respondent herein (Annexure-R and T respectively) and order dated 05.05.2020 passed by the 3rd respondent (Annexure-W) are hereby set aside. (iii) Matter is remitted to respondent - Bank to conduct de-novo enquiry in terms of the observations made above from the stage referred to above." 2.1 It is in respect of the above direction that the present contempt petition is filed. 3. In course of the hearing today, learned advocate for the respondent-Bank stated that in light of the directions of learned Single Judge, the Bank conducted de novo inquiry and that the - 4 - NC: 2025:KHC:10912-DB CCC No. 144 of 2024 inquiry has concluded with imposition of penalty of dismissal against the complainant. 4. While learned advocate for the respondent-Bank would submit that in light of conclusion of the inquiry the directions are complied with, learned advocate for the complainant harped that during the inquiry, the material documents were not supplied to the complainant although it was observed by learned Single Judge for supply of such documents. 5. When all the stages of inquiry have been completed which was the operative part remitting the matter to the Bank to conduct the de novo inquiry, question of commission of willful contempt of court by any of the respondents does not arise. 6. If the complainant has any grievance about the inquiry proceedings including non-supply of the alleged material documents, the only recourse for the complainant is to institute independent proceedings to challenge the inquiry on the grounds which may be available in law, if so advised. 7. Reserving such liberty to the complainant, this contempt petition is disposed of as not surviving. - 5 - NC: 2025:KHC:10912-DB CCC No. 144 of 2024 It is clarified that this court has not expressed any opinion on merits of the case including the contention of the complainant about non-supply of the material documents.
