Neutral Citation No. - 2025:AHC-LKO:39483 Court No. - 8 Case :- APPEAL UNDER SECTION 37 OF ARBITRATION AND CONCILIATION ACT 1996 No. - 17 of 2019 Appellant :- Aways Khan Respondent :- Arbitral Tribunal Thru. Sole Arbitrator And Others Counsel for Appellant :- Dwijendra Mishra,Vishva Deep Pandey Hon'ble Jaspreet Singh,J.
Learned counsel for the appellant was put to a specific query as to how the instant appeal was maintainable before this Court since the order impugned has been passed by the Arbitral Tribunal in terms of Section 17 of the Arbitration and Conciliation Act, 1996.
Learned counsel for the appellant after arguing at some length could not dispute the fact that in terms of Section 37(2) of the Act of 1996, the appeal can only be preferred before the court, which is defined in terms of Section 2(e) of the Act of 1996. This being the position, the instant appeal is not maintainable and is accordingly dismissed leaving it open to the appellant to take recourse as that may be available to it in law.
