Petitioner was employed as Care Taker by Orange Pekoe Residents Welfare Society, which is registered under Societies Registration Act, 1860. Services of the petitioner were terminated by Society in the month of October, 2025. Thus, feeling aggrieved, petitioner has approached this Court. 5. Since Society is purely a private body not receiving any financial aid from the State or Central Government, nor Government has any degree of administrative control over the Society, therefore, by applying the test laid down by Apex Court in the case of Pradeep Kumar Biswas vs. Indian Institute of Chemical Biology & others, reported in (2002) 5 SCC 111, this Court is of the view that writ petition would not be maintainable for the relief sought by the petitioner. 6. Accordingly, the writ petition is dismissed as not maintainable with liberty to petitioner to approach the Competent Authority.
