The petitioner who claims to have failed in the last attempt and has even failed after having resorted to re-checking and re-evaluation of the answer papers is before us with his back to the wall and is seeking a sympathetic order directing the respondent-university to resort to some re- checking or re-evaluation de hors the rules and ordinance governing the matters of re-evaluation of the answer papers. 2. With all the sympathies, in the absence of any regulation permitting such course to be resorted to, we cannot issue a writ of mandamus under Article 226 of the Constitution of India to do something which is not contemplated in law.
