Heard Shri Harsh Singh, Advocate holding brief of Shri Santosh Kumar Tripathi, learned counsel for the revisionist, learned A.G.A. for the State and perused the record. 2. The present revision has been filed by the revisionist for the following main relief(s):- "WHEREFORE, it is most respectfully prayed that this Hon'ble court may kindly be pleased to summon the record of court below, set aside the judgment and order dated 16.06.2025 passed by the Additional District & Sessions Judge (Fast Track Court-1), Ambedkar Nagar in S.T. No. 37 of 2025, Computer No. 189 of 2025 (State of U.P. Versus Shubham Gupta and others) under section 395, 397 I.P.C. relating to F.I.R. Case Crime No. 135 of 2020, P.S. Akbarpur, District Nagar and allow the instant revision so far it relates to the revisionist, in the interest of justice." 3. After arguing the matter at some length, Shri Harsh Singh, Advocate holding brief of Shri Santosh Kumar Tripathi, learned counsel for the revisionist prays for withdrawal of the revision with liberty to the revisionist to file a fresh revision with proper pleadings and documents in support thereof including the statements of the eye-witnesses, which have not been placed on record. 4. The aforesaid prayer has not been opposed by learned A.G.A. 5. In view of the above, the instant application is dismissed as withdrawn with liberty, as prayed for. 6. Office is directed to return the certified copies of the documents annexed with this revision to the learned counsel for the revisionist as per relevant Rules in this regard.
